Federal Court in Philadelphia to Enter Permanent Injunction against Accused Infringers in First PA Case to Reach Resolution

GREENVILLE, N.C., Aug. 20, 2024 /PRNewswire/ — Banilla Games is a highly successful designer, developer, and distributor of products for various board, nudge, skill, redemption, and amusement game markets. In particular, Banilla’s “Fusion” line of electronic skill games has seen tremendous commercial success.

The success of Banilla’s games has led a few unscrupulous individuals and entities to sell counterfeit versions of Banilla’s games. While “imitation is the sincerest form of flattery,” Banilla takes seriously the protection of its games (and their underlying intellectual property (“IP”)); utilizing all means necessary to stop the proliferation of counterfeit games. Accordingly, Banilla began an IP enforcement campaign in late 2021.

Earlier this year, Banilla expanded its IP enforcement campaign into Pennsylvania, filing three lawsuits against accused infringers, and sending notice to a number of other infringers. Last week, Banilla resolved one of those matters on terms favorable to Banilla, including a meaningful monetary recovery, and as also reflected in the stipulated permanent injunction agreed to by the defendants.  

To date, Banilla has brought 36 cases for IP infringement against locations, route operators, and domestic and Chinese manufacturers who place and traffic in counterfeit Banilla products. Cases have been in ten federal judicial districts across six states. The awards and settlements in those cases include several “six-figure” amounts, including an award of damages and attorneys’ fees in Texas for $338,883.95 for willful infringement.

The message for the unscrupulous is simple: Dabble in counterfeit Banilla devices, and the company will find you and bring you to account.

Engine

This platform pushes peak performance over the top, with a new Rotax engine, giving it industry-leading horsepower and performance. The double-overhead camshaft 999cc V-twin utilizes a high compression ratio with a high-efficiency intake and exhaust, making the Outlander 1000R the first ATV with triple-digit horsepower, at 101 hp. The new 1000R boasts the fastest acceleration in the industry. The Outlander 850 also offers impressive power, producing 82 hp. Both models include Work, Standard and Sport ride modes, optimizing power delivery and performance for the task at hand.

Transmission

The Outlander 850 and 1000R are equipped with an all-new continuously variable transmission (CVT) that delivers smooth power to the ground, consistent shifts, improves torque and reduces maintenance requirements. The latest pDrive primary clutch is paired with a new, dual-roller-driven pulley, offering instant response and rock-solid reliability.

Chassis & Suspension

More power and higher speeds require greater suspension and handling capability. Designed for ultimate comfort and stability, the Outlander features a new suspension configuration with wide, arched A-arms front and rear, allowing for enhanced vehicle dynamics, including an improved attack angle for smooth obstacle and ditch crossing. Front suspension travel has increased by 1.6 inches to 10.8 inches, while rear suspension has increased by 2.1 inches to 12 inches of travel, offering superior performance and comfort, along with additional ground clearance to crawl over any obstacle on the trail.

Complementing the updated suspension, the steering geometry is also revised, increasing high-speed stability, steering precision and turning radius. A high-strength steel frame enhances durability and rigidity while decreasing weight. The full-length skidplate provides heavy-duty protection.

The 1000R and X mr versions feature a new four-disc system for ultimate braking control. The braking system now offers greater capacity and modulation thanks in part to new metallic brake pads and a new front brake lever with optimized ergonomics.

When it comes to work, the Outlander continues to impress with a class-leading towing capacity of 1,830 pounds and a heavy-duty two-inch hitch receiver.

Design & Technology

With iconic Can-Am styling, the new Outlander pairs comfortable ergonomics with a tough, trail-ready design. Restyled components include front and rear LED lights with a four-point design, a centralized exhaust with an aluminum muffler tip, new wheel design on select packages, specifically designed XPS tires and integrated front and rear bumpers. A new 10-liter (2.5-gallon) rear LinQ removable storage box and 30 liters (8 gallons) of front dropdown storage offer plenty of room for tools and supplies while select packages feature a cell phone storage compartment with a USB charging port.

The Max Limited package features an industry-leading 10.25″ touchscreen display with smartphone connectivity. Using the BRP GO! app, riders can access off-road maps, drive settings and more.

Outlander X mr

For riders who call mudholes their playground, the Outlander X mr 850 and 1000R are the ultimate purpose-built machines. The intake, CVT vent and radiator have been repositioned higher to enhance airflow, even when riding in the deepest mud. Similarly, the front bumper is mounted higher and features a 3,500-lb. winch with synthetic rope, designed for getting riders out of the stickiest situations. Ensuring maximum traction in challenging conditions, the Outlander X mr models feature new 30-inch XPS Swamp King XL tires, developed specifically for this machine.  An aluminum handlebar with a one-inch riser facilitates optimal riding position, while the J-hook and mud strap offer higher leverage points for vehicle recovery, a feature that is exclusive to the Outlander 1000R X mr. The reinforced, LinQ-compatible rear rack features integrated grab handles that can be used to help riders get out of tough spots.

Construction Officially Underway for Galveston’s 4th Cruise Terminal – Future Home of MSC Seascape





































Galveston Wharves celebrated the construction start on Aug. 20 at a ceremony at Pier 16 with executives from MSC Cruises and the Cruise Lines International Association (CLIA), elected officials, community leaders and other port partners.

During the ceremony, Rodger Rees, Galveston Wharves port director and CEO, and Rick Sasso, MSC Cruises U.S. chairman, drew back a curtain to debut a large-scale rendering of the terminal complex with MSC Seascape docked alongside to applause from a crowd of more than 100.

Rees said, “We have so much to celebrate today with this milestone and what it means to our community, cruise guests and port partners. This beautiful new terminal will generate jobs and economic growth for the region, an exciting new cruise choice for our market, and growth opportunities for our port partners.

“We also want to take this opportunity to give a warm, Texas-sized welcome to MSC Cruises, the world’s third largest cruise line. Having a cruise line of this stature homeporting in Galveston says a great deal about our position in the U.S. and global cruise markets.”

With the opening of the fourth terminal, Rees added that he expects the port to reach more than 2 million passengers a year beginning in 2026, which would be a new milestone in Galveston’s 24 years as a cruise home port.

During his comments, Sasso said, “The groundbreaking for Cruise Terminal 16 marks a significant milestone in MSC Cruises’ ongoing U.S. expansion. Adding Galveston as our fourth homeport will make it even easier for travelers from the central and western parts of the country to enjoy our distinctive mix of European style and American comfort.

‘A Game-Changer for the Community’
U.S. Congressman Randy Weber told the crowd at the groundbreaking ceremony: “I’m thrilled about the groundbreaking of our fourth cruise terminal at the Port of Galveston. His leadership is putting Galveston on the map as a top cruise destination and keeping our port bustling with activity. Regional Economic Benefits
The local impact of the port’s 2022 cruise activity included 3,500 jobs, $568 million in local business revenue, and $73.5 million in local purchases by passengers and crew. The fourth cruise terminal is forecast to generate an additional 925 jobs and $177 million in local business revenue annually.

The city of Galveston will benefit directly with passenger fees and sales tax revenues from cruise parking.

Club Med Musandam, New Exclusive Collection Resort Opening in Oman in 2028
Club Med is developing its first property in the Gulf States: Club Med Musandam, a luxurious beach resort set to open in 2028 in Oman. The 300-room, Exclusive Collection (5-star) resort will incorporate the culture of Oman in its design, entertainment, food & beverage, and provide guests with access to a private beach with incredible scenery. Situated on the Arabian Peninsula overlooking the Persian Gulf and panoramic Hajar Mountains, Musandam has earned the nickname, “The Norway of Arabia,” for having the world’s only desert fjords. Club Med Musandam will include all the amenities that Club Med guests have come to expect—gourmet dining, Children’s Clubs, wellness experiences, an adults-only area, spa, an array of land & water sports—plus the hassle-free convenience of an all-inclusive vacation. The resort is only a 5-minute boat ride from Khasab City and 2.5 hours from Dubai International Airport, making it an attractive destination for both local and international travelers. The project is a collaboration between Club Med, Royal Court Affairs and Omran Group, which has invested over $100 million into its development. Club Med Musandam will be another addition to Club Med’s luxurious Exclusive Collection—a portfolio of 5-star resorts, spaces, villas and chalets, and a legendary French sailing yacht.

Club Med Kiroro Grand Included in Travel + Leisure’s “It List 2024”
Club Med is proud to announce that its newest resort, Club Med Kiroro Grand, has been chosen for Travel + Leisure‘s prestigious It List 2024, which recognizes the best new hotels of the year. The selection process, which reviewed over 200 hotels, highlighted Club Med Kiroro Grand for its exceptional all-inclusive ski offering and guest experience.

Located in Hokkaido, the internationally renowned ski destination of Japan, this untouched mountain features powder snow, unique ski trails, and an impressive 160-day season that guests travel from all over the world to experience. Club Med Kiroro Grand offers ski-in and ski-out access to a domain with 23 courses suitable for all levels, along with lift passes and group lessons included for skiing and snowboarding. The resort is designed with a distinctive enchanted forest theme, inspired by the dreamlike scenery of Kiroro’s natural landscape, which can be seen throughout the 266-room property. After a day on the slopes, guests can indulge in Japanese-inspired dining or unwind in a traditional Japanese onsen at the Club Med Spa by Mandara. Club Med Launches Yoga Partnership with Jonah Kest
Club Med launches a new partnership with world-renowned yoga instructor Jonah Kest, who serves as the Yoga Ambassador across the brand’s North American and Caribbean resorts. Born into a yoga legacy, Jonah is a globally celebrated Ashtanga and Vinyasa yoga teacher known for his inspiring classes and collaborations with leading brands like Nike and Netflix. Jonah will enrich Club Med’s Wellness Fusion program, which launched in 2022, to offer guests a well-rounded stay with yoga, healthy nutrition, active sports, spa relaxation and nature reconnection. Jonah’s contributions will include developing the yoga program for guests; teaching in-person classes at select resorts; and continually training the yoga instructors. Jonah will lead classes at Club Med Québec Charlevoix’s Wellness Fusion Festival (Sep 1 – Oct 15), a dynamic lineup of mountainside events that are part of the resort’s summerlong Elevation Celebrations. From September 2-5, Jonah will kick-off the festival with a transformative schedule of yoga classes and wellness workshops.

“Happy to Care” Sustainability Achievements
Club Med announces new CSR achievements as the brand continues to invest significantly in sustainability efforts dedicated to responsible tourism with a focus on contributing locally and consuming responsibly through energy management and minimization of single-use plastics. Key initiatives for 2024-2025 include:

  • Worldwide Snack: Since 1978, the Club Med Foundation, one of the oldest corporate foundations, has been dedicated to the solidarity and well-being of its guests (G.Ms) and staff (G.Os). Committed to youth, education, and recreation, it encourages G.Os involvement in local projects, such as Worldwide Snack, which invites children from local schools to experience the magic of a Club Med resort. Club Med provides meals and activities and also raises funds to improve their daily lives. In June and July, the North American resorts welcomed various local schools and hundreds of children for the annual Worldwide Snack event.
  • Minimization of Plastics: Club Med’s “Bye Bye Plastic Program” commits to minimizing single-use plastics in Club Med’s North America resorts in the main restaurants, bars and rooms. Club Med Michès Playa Esmeralda leads the way by providing guests with reusable, biodegradable, and glass alternatives (including in-room, glass refillable water bottles) throughout the resort, saving over 60,000 plastic bottles annually.
  • Recycled Uniforms: Club Med uniforms are now 100% recycled and crafted from plastic bottles. This switch has allowed Club Med to recycle over 2.3 million plastic bottles.
  • World Ocean Day at Club Med: Club Med reaffirmed its commitment to the Earth’s most precious resource through several conservation programs on World Ocean Day (June 8) and beyond.
    • Club Med Columbus fosters three coral nurseries in the Bahamas, nurturing 300+ baby corals.
    • Club Med Turkoise safeguards 200+ baby coral in Turks & Caicos, enhancing marine biodiversity in the area.
    • Since 2022, Club Med has successfully released over 13,500 sea turtles and safeguarded more than 1,400 eggs. Its dedicated turtle camps in Mexico (Cancún and Ixtapa Pacific) and the Dominican Republic (Michès Playa Esmeralda) engaged over 530 guests, inviting them to play a direct role in crucial conservation efforts.
    • Club Med offers whale watching excursions at Club Med Québec Charlevoix and Club Med Michès Playa Esmeralda, bringing guests closer to nature to learn about ocean preservation and biodiversity.
    • Club Med is turning the tide against ocean pollution through its Bye Bye Plastic program, beach clean-ups, and plastic collection dives, which are available to guests at Club Med Cancún. Club Med Columbus has also installed water fountains on its boats, saving 27,000 cups per 10-month season.
  • G.Os and G.Ms Take Action: Club Med staff (G.Os) and guests (G.Ms) lead eco-friendly efforts through beach and mountain cleanups. At Club Med Cancún, for example, guests recycle bottle caps and support children’s cancer programs with the proceeds. To date, Club Med has contributed 800 tons of caps, benefiting 420 patients, in partnership with El Banco de Tapitas. Guests can also take action through plastic collection dives to safeguard marine ecosystems in collaboration with Only Blue for Reef.
  • BREEAM Certification: Club Med La Rosière’s Exclusive Collection space has achieved BREEAM Certification, highlighting the brand’s ongoing commitment to enhancing sustainable operations worldwide.

  • Thrill Island – There are thrills of all kinds with Category 6, the first waterpark at sea when introduced on Icon, and its six record-breaking waterslides – from family raft slides to a drop slide and mat-racing duos; Crown’s Edge, the part skywalk and thrill ride 154 feet above the ocean; plus longtime favorites, the FlowRider surf simulator and mini golf, and spots to grab a bite and drinks like Basecamp and Desserted.

The four-day program enables Canyon Ranch guests to undergo 15 diagnostic tests and assesses more than 200 biomarkers including blood work, cancer screening and genetic testing.
